Apple iPhone 3G Class Action

A class action titled Pittman vs. Apple, Inc. was filed by Litigation Law Group in the United States District Court for the Northern District of California. This law suit is brought on behalf of a class defined as "All persons in the United States who owned the iPhone 3G and/or who paid or data service on the iPhone 3G, except for employees, officers and directors of Apple, Inc."

The complaint alleges that the iPhone 3G was rushed to market in a defective state. It alleges that adopters of the second-generation Apple iPhone, introduced in the fall of 2008, did not receive the promised and paid-for "twice as fast" data speeds, compared to the previous-generation iPhone. The complaint alleges that, due to defective hardware and firmware, users experienced greatly increased dropped calls and other problems when using the iPhone in 3G mode.

The complaint quotes a report in iPhone Buz by Chris Davies on August 12, 2008, which suggested the problems may be due to a faulty chipset:

The ongoing reception issues faced by many iPhone 3G users may be due to its
lnfineon 3G chipset and the protocol stack that it uses, according io Nomura
Securities analyst Richard Windsor. In a research note released today, Windsor
pointed the blame at Infineon as presumed 3G chipset supplier and suggested that
their "immature" protocol software was key to the Apple cellphone's woes: "We
believe that these issues are typical of an immature chipset and radio protocol
stack where we are almost certain Infineon is the 3G supplier" Richard Windsor,
analyst, Nomura Securities.

On July 1, 2009, after hearing the arguments of the parties, the Judicial Panel on MultiDistrict Litigation ruled that all related iPhone 3G class action cases filed in the United States be transferred to the Northern District of California, for coordination with Pittman and the other actions later filed in or moved to the Northern District of California. Counsel for Plaintiffs are presently in the process of preparing and filing a consolidated complaint.
